It is Congress’s job is to end this shutdown and fund SNAP and other programs. We ask the First Circuit to get courts out of the business of deciding how to triage scarce funds during a shutdown. When lawless district courts step in to try to manage the federal fisc, it upends the political process and unacceptably risks compromising the programs for everyone.

So, Judge McConnell exacerbated his own manufactured emergency by starting the government’s clock just after the First Circuit closed for the day, forcing an even faster rush today to disadvantage the government further.

Why could we file this brief only this morning, with that clock ticking? The First Circuit clerk’s office made it impossible to file sooner. Despite being notified by the government of the high likelihood of fast-moving litigation, the First Circuit clerk’s office refused to answer its phones until this morning, and refused to offer any means of filing this emergency request until it processed certain paperwork during regular business hours.

Let this serve as a reminder that if you commit violence against a law enforcement officer, you WILL face severe consequences.
Promises made, promises kept. The President and @AGPamBondi made clear that we will find, arrest, and charge anyone who attacks our federal agents. This morning we arrested 10 defendants for engaging in violence against officers and property earlier this year in connection with anti-immigration enforcement protests. They are now in federal custody. Among those arrested is Isai Carrillo, who was part of a violent group that attacked and threw rocks at federal agents as they exited the Glass House marijuana farm raid this summer. Peaceful protest is protected. Violence is not. Agitators who harm our officers, agents, and property will be brought to justice.

Exclusive with @CarolLeonnig: The federal prosecutor in charge of investigating whether Sen. Adam Schiff should be charged with mortgage fraud recently told her bosses in Washington she did not think the case was strong enough to move forward, two sources familiar with the matter told MSNBC. A third person familiar with the matter said the case is continuing to be investigated. Kelly Hayes, the U.S. Attorney in Maryland, met in recent days with Todd Blanche, the deputy Attorney General, to update him on the Schiff case, the three people said. Hayes, an experienced federal prosecutor, told Blanche she did not think the case against Schiff was strong, two people said. The two said Ed Martin, a controversial senior Justice Department official, is pressing to keep the case alive.
