Under the Criminal Code of Canada act - Sections 445 (1) & 446 (1) -
The Criminal Code of Canada prohibits animal abuse and cruelty under sections 445 to 447, which make it an offense to willfully cause unnecessary pain or suffering to an animal, neglect an animal, or engage in specific acts like animal fighting or poisoning. The laws cover a range of actions, from intentional harm to neglect in providing care, and define punishments based on the severity of the offense.
There are offences for killing and harming animals (445), torturing animals (445.1), and neglecting animals (446). They are all found in Part XI of the Criminal Code relating to "Wilful and Forbidden Acts in Respect of Certain Property"
In fact you could say that outdated policies that should indicate re-testing to justify any cull should have been included in this scenario as the last test was carried out 10 months ago & there should have been current testing for justification not just an initial test from 10 months ago. Their policies indicate initial test but there should be provision for retesting as the need was required here in this scenario. The CFIA should really be liable for animal cruelty due to neglect during the stay order. The spirit scenario when they didn’t provide the bird with the necessary electrolytes & the farm has footage on this which indicates neglect. During the stay order, there were also lesser birds than before so they were probably culling them then - but they didn’t allow for a count further avoiding evidence - violating the stay order - every investigation requires current evidence they didn’t carry out current testing - could make them liable for harm under animal cruelty also. Their policies are clearly out of date & were not sufficiently updated to cover this scenario. It’s not looking good for the CFIA or the Supreme Court - the Supreme Court should have put a stop to the cull & investigated this & held the CFIA accountable, instead they abandoned the case so the Supreme Court failed to apply duty of care.
